Der österreichische Gesetzgeber wollte mit § 37a öUrhG eine § 38 Abs 4 dUrhG im Wesentlichen nachempfundene Regelung für die Zweitverwertung einführen. Neben dem bewusst „ausgeweiteten“ persönlichen Anwendungsbereich weichen die vom Wortlaut der beiden Bestimmungen erfassten Zweitverwertungen aber auch in anderen Punkten voneinander ab. So kommt § 37a öUrhG mangels Aufnahme in die Liste des § 37f öUrhG nicht zweifelsfrei der Charakter einer Eingriffsnorm zu, obwohl sich dieser mitunter aufgrund des mit der Bestimmung verfolgten öffentlichen Interesses durchaus auch begründen ließe. Darüber hinaus erfasst der Wortlaut der Bestimmung lediglich das wissenschaftliche Personal i.S.d. UG 2002, das künstlerische Personal kann aber mittels Analogieschlusses erfasst werden. Schließlich spricht die Entstehungsgeschichte auch dafür, die über die Online-Verwertung hinausgehenden Verwertungsformen mittels teleologischer Reduktion vom Anwendungsbereich auszuschließen.
With Section 37a of the Austrian Copyright Law (öUrhG), the Austrian legislator intended to introduce a provision for secondary exploitation that is essentially modeled on Section 38 (4) of the German Copyright Law (dUrhG). In addition to the deliberately “extended” personal scope of application, the secondary exploitations covered by the wording of the two provisions also differ in other respects. For example, Section 37a öUrhG, because it is not included in the list of Section 37f öUrhG, is not unequivocally considered to be an overriding mandatory provisions, although this could certainly be justified on the basis of the public interest pursued by the provision. Moreover, the wording of the provision only covers academic staff as defined by the University Law (UG 2002), but artistic staff can be covered by analogy. Finally, the legislative history also argues in favor of excluding forms of exploitation beyond online exploitation from the scope of application by means of teleological reduction.
