Änderungen im Straf- und Strafprozessrecht führen mitunter zu versteckten, grundrechtsrelevanten Verwerfungen. So kann die Möglichkeit der praktischen Grundrechtswahrnehmung auch nahezu unbemerkt Opfer von Gesetzgebung und gesellschaftlicher Entwicklung werden, insbesondere wenn der Gesetzgeber die Auswirkungen seiner Gesetzgebung nicht vollständig erfasst. Im Folgenden sollen eben diese Auswirkungen der modernen Kriminalgesetzgebung und gesellschaftlichen Strukturveränderungen auf die Möglichkeit des Beschuldigten im Strafverfahren seine (Prozess-)Grundrechte effektiv wahrzunehmen untersucht werden. Insoweit beschäftigt sich der Text mit einem nur vermeintlichen Randbereich: Dem Zugang zum Recht, der (in der Praxis) ebenso wichtig ist wie das Recht selbst.
The access to justice is practically as important as the law itself. It is put in jeopardy by conflicts of interest of the legal counselors. The dissolution of formal procedures of the criminal proceedings caused by negotiated agreements and leniency with the purpose of resource-efficient target attainment requires a strict formalization of the roles of the parties. The knowledge of, compliance with and correct interpretation of the prohibition of betrayal of the client as set forth in section 356 of the German Code of Criminal Procedure may contribute to mitigate the negative effects of negotiated agreements and leniency without legislative amendment. The betrayal of the client being a punishable offence thus forces restraint when applying these structurally vague norms.
