Die Verordnung (EG) Nr. 207/2009 des Rates vom 26. Februar 2009 über die Gemeinschaftsmarke dient dem reibungslosen Funktionieren des Binnenmarktes, der mit einem einzelstaatlichen Markt vergleichbare Bedingungen bieten soll. Um einen solchen Markt zu verwirklichen und seine Einheit zu stärken, müssen auch rechtliche Bedingungen geschaffen werden, die es den Unternehmen ermöglichen, ihre Tätigkeiten in den Bereichen der Herstellung und der Verteilung von Waren und des Dienstleistungsverkehrs an die Dimensionen eines gemeinsamen Marktes anzupassen. Abstract

Council Regulation (EC) No. 207/2009 of 26 February 2009 on community trade constitutes the legal framework for the European Single Market. It guarantees legal protection to companies’ labels and trademarks and protects their goods and services in the whole European Union without restriction. This new commentary discusses the protection mechanisms. It is a “must have” for everyone dealing with legal issues in the field of design and trademark rights and ensures professional management in conformity with the European design and trademark laws.
