Subventionsbetrug bei Verstößen gegen Vorgaben im europäischen Agrarsektor

Abstract
The system of cross-compliance/conditionality makes the payment of agricultural subsidies subject to the condition that certain socially desirable requirements, such as animal welfare requirements, are met. The work addresses the question of the extent to which violations of such requirements within the framework of national and European agricultural subsidy law can lead to criminal liability when applying for subsidies. The starting point for the considerations is the high proportion of agricultural subsidies in the EU budget, so that monitoring and criminal sanctions in the event of misuse appear to be self-evident and absolutely necessary in order to ensure effective use. The focus of the investigation is on subsidy fraud.
Zusammenfassung
Das System der Cross-Compliance/Konditionalität stellt die Leistung von Agrarsubventionen unter die Bedingung, dass bestimmte gesellschaftlich gewünschte Anforderungen, wie etwa Vorgaben des Tierschutzes eingehalten werden. Das Werk widmet sich der Frage, inwieweit Verstöße gegen solche Vorgaben im Rahmen des nationalen und europäischen Agrarförderungsrechts bei der Beantragung von Subventionen zur Strafbarkeit führen kann. Ausgangspunkt der Überlegungen ist dabei der hohe Anteil der Agrarsubventionen im Haushalt der EU, so dass eine Kontrolle und strafrechtliche Sanktion bei Missbrauch selbstverständlich und zwingend erforderlich erscheinen, um eine effektive Verwendung abzusichern. Im Fokus der Untersuchung steht dabei der Subventionsbetrug.
