Jüngst haben Mitgliedstaaten ihren Rücktritt vom Römischen Statut angedroht, Burundi ist nun tatsächlich ausgetreten, und die Afrikanische Union hat ihren Mitgliedern 2017 sogar empfohlen, geschlossen auszutreten. Die Gerichtsbarkeit des IStGH für das Verbrechen der Aggression wurde während der 16. Sitzung der Versammlung der Vertragsstaaten im Dezember 2017 aktiviert. Als Sanktionierung des Angriffskriegs berührt es die staatliche Souveränität unmittelbar und kann so ein weiteres politisches Spannungsfeld eröffnen. Über die derzeit diskutierte „Krise“ des Völkerstrafrechts haben wir mit IStGH-Richter Prof. Dr. Bertram Schmitt am 20.11.2017 in Den Haag gesprochen. Auf laufende Verfahren sowie auf Rechtsfragen, mit denen er als Richter künftig befasst werden könnte, wie z.B. die Auslegung und Anwendung des Verbrechens der Aggression, und die Auswirkungen einer möglichen erstmaligen Anklage wegen geschlechtsbasierter Verfolgung als Verbrechen gegen die Menschlichkeit, konnte Herr Prof. Schmitt nicht eingehen.
