Mit Inkrafttreten des Rom-Statuts des Internationalen Strafgerichtshofes am 1. Juli 2002 wurde der ICC in die Lage versetzt, die Präambel des Statuts wirksam zu bekräftigen: »… dass die schwersten Verbrechen, welche die internationale Gemeinschaft als Ganzes berühren, nicht unbestraft bleiben dürfen und dass ihre wirksame Verfolgung durch Maßnahmen auf einzelstaatlicher Ebene und durch verstärkte internationale Zusammenarbeit gewährleistet werden muss«. Dieser Kommentar erläutert in englischer Sprache und Artikel für Artikel sowohl das Rom-Statut als auch die von den Mitgliedern der Versammlung der Vertragsstaaten 2002 verabschiedeten »Verbrechenselemente«, die »Verfahrens- und Beweisordnung« sowie die 2004 von den Richtern verabschiedete »Geschäftsordnung des Gerichtshofes«.
