note = {A paradigm shift can currently be seen to be happening in terms of how
conflicts are handled: the range of different conflict management
procedures on offer is becoming increasingly varied. Mediation as a
procedure of establishing interests in a structured manner assumes a
key role within this. On the one hand, it can help support the parties
involved in the conflict to select the procedure which is most suited
for handling their conflict, whilst, on the other hand, mediation can
itself be selected as the procedure for managing the conflict.
Mediation, however, not only initiates and promotes self-determination
within conflicts, but it also sets this as a precondition. This
contribution will help to illustrate that mediation runs the risk of
discrediting itself if it is exploited by stronger parties to the
detriment of weaker parties. The aim is to develop mechanisms aimed at
protecting the weaker parties in mediation procedures so as to ensure
that they do not have to be protected from mediation.},
