Mediation as a procedure of establishing interests in a structured manner assumes a key role within this. On the one hand, it can help support the parties involved in the conflict to select the procedure which is most suited for handling their conflict, whilst, on the other hand, mediation can itself be selected as the procedure for managing the conflict. Mediation, however, not only initiates and promotes self-determination within conflicts, but it also sets this as a precondition. This contribution will help to illustrate that mediation runs the risk of discrediting itself if it is exploited by stronger parties to the detriment of weaker parties.
