Article 12 obliges the Member States of the EU to guarantee effective remedies for violation of the rights deriving from the Directive, including the right to counsel. Yet no further guidelines for remedies that could be considered “effective” are given in the Directive. This article argues that due to the prominent status of the right to counsel among the defence rights, there are only a number of remedies that effectively cure its violation.
