Zusammenfassung
Die Aufsatzsammlung enthält wissenschaftliche Beiträge zu Recht, Wirtschaft und Gesellschaft in der Europäischen Union.
Die Verfassung der EU, die auf dem EU-Vertrag und der Rechtsprechung des EuGH beruht, begründet das spannungsreiche Verhältnis zur Souveränität der Mitgliedstaaten, wie es durch deren Verfassungsgerichte interpretiert wird. Die daraus folgenden potenziellen Verfassungskonflikte werden für die Finanzkrise und für das Verhältnis von europäischem und deutschem Grundrechtsschutz in der Rechtsprechung des Bundesverfassungsgerichts analysiert.
Von übergreifender methodischer Relevanz für das Verhältnis von Recht und Ökonomie wie auch für die Rechtsprechung des EuGH und die Verwaltungspraxis der Kommission ist der Gegensatz von utilitaristisch angeleiteter Wohlfahrtsmaximierung und subjektiven Freiheitsrechten. Die Tradition der bürgerlichen Gesellschaft und ihres Rechts wird verglichen mit der civil society on constitutional liberty in der anglo-amerikanischen Tradition.
