Abstract
Hardly any other technology has shaped the recent debates as much as the phenomenon of AI. This PhD thesis examines the extent to which the liability system under personality law is still able to meet the resulting challenges of ChatGPT, Dall-E & Co. This legal study not only analyzes the technical background and its consequences for the liability system, but also discusses the opportunities and risks of artificial intelligence using media science findings. Based on this, the extent to which expression and image law can adequately cover AI-generated content is comprehensively examined.
Zusammenfassung
Kaum eine Technologie hat die Debatten der vergangenen Monate so stark geprägt wie das Phänomen KI. Diese Arbeit untersucht, inwieweit das persönlichkeitsrechtliche Haftungssystem im Angesicht von ChatGPT, Dall-E & Co. noch in der Lage ist, den hieraus erwachsenden Herausforderungen zu begegnen. Im Rahmen dieser juristischen Untersuchung wird nicht nur der technische Hintergrund sowie dessen Folgen für das Haftungssystem analysiert, sondern auch die Chancen und Gefahren künstlicher Intelligenz unter Heranziehung medienwissenschaftlicher Erkenntnisse erörtert. Darauf aufbauend wird umfassend untersucht, inwieweit das Äußerungs- und Bildrecht KI-erzeugte Inhalte hinreichend erfassen kann.
