Zusammenfassung
Im Zuge der wachsenden Bedeutung der Circular Economy im Rahmen der politischen Agenda bestimmen die Themen Abfallvermeidung und Produkt-Ökodesign zunehmend die umwelt- und abfallrechtlichen Debatten. Basierend auf einer rechtsökonomischen Analyse des Umweltrechts bietet dieses Buch eine rechtsvergleichende Untersuchung des Abfallrechts und des produktbezogenen Umweltrechts Brasiliens und der EU, um der Frage nachzugehen, ob und was Brasilien im Zusammenhang mit der Vermeidung von Abfällen durch Produkt-Ökodesign-Regulierung von der EU lernen kann. Beispiele sowohl für indirekte Steuerung wie die erweiterte Herstellerverantwortung als auch für direkte Steuerung wie die Ökodesign-Richtlinie werden eingehend untersucht, um in beiden Rechtssystemen Verbesserungspotenzial aufzuzeigen.
Abstract
Waste prevention and product ecodesign are increasingly becoming central issues as the debate on circular economy gains considerable momentum on the political agenda. Based on a legal-economic analysis of environmental law, this book provides a comparative examination of Brazilian and EU waste and product-related environmental law to answer the question of what lessons Brazil can learn from the European Union to prevent waste through product ecodesign regulation, if any. Examples of both indirect regulation such as extended producer responsibility, and direct regulation such as the Ecodesign Directive are scrutinised, showing that there is room for improvement in both jurisdictions.
