Zusammenfassung
In der globalen Informationsgesellschaft entstehen komplexe normative Ordnungen, die sich nicht mehr nahtlos in die normative Logik der Nationalstaaten übersetzen lassen. Zentrale Akteure in dieser Informationsgesellschaft sind die Intermediäre des Internets, etwa Meta (ehemals Facebook) oder Alphabet (ehemals Google). Aus ihrem Handeln emergiert eine neue transnationale Rechtsordnung – eine lex digitalis intermedia. Bodo P. Bützler legt eine multidisziplinäre Untersuchung dieser transnationalen Rechtsordnung unter Berücksichtigung relevanter ökonomischer, rechtswissenschaftlicher und philosophischer Diskurse vor. Er erörtert, ob und wie (d.h. anhand welcher Kriterien) eine Rechtsordnung, die zunehmend von privaten, nicht-staatlichen Akteuren geprägt wird, noch als legitim qualifiziert werden kann. Das Buch schlägt dafür ein innovatives, funktionales Verständnis von Legitimität vor.
