Zusammenfassung
Menschenhandel ist ein ernstes Problem in Europa, sodass ein adäquater Schutz der Opfer notwendig ist. Der Europäische Gerichtshof für Menschenrechte (EGMR) hat erst in jüngerer Vergangenheit diese Thematik in seiner Rechtsprechung aufgegriffen. Angesichts der Bedeutung der EGMR-Rechtsprechung für den europäischen Menschenrechtsstandard, liefert dieses Buch eine Analyse der vorhandenen einschlägigen EGMR-Rechtsprechung zu Art. 4 EMRK in Bezug auf Menschenhandel. Ziel ist es, festzustellen, wie Opfer von Menschenhandel durch die Europäische Menschenrechtskonvention geschützt werden und aufzuzeigen, welche Fragen noch offen sind. Zudem wird die Frage bearbeitet, ob Österreich den gebotenen Schutzstandard für Opfer des Menschenhandels erfüllt.
Abstract
Human trafficking is a serious problem in Europe. Therefore, adequate protection of human trafficking victims is necessary. The European Court of Human Rights (ECtHR) has only recently started to consider the issue under the framework of the European Convention on Human Rights (ECHR). In light of the significance of the Court’s case law for the evolution of European human rights, this book provides an analysis of the existing relevant ECtHR case law on article 4 of the ECHR concerning human trafficking. It aims to examine how victims of human trafficking are to be protected and to highlight unresolved questions. This book further investigates whether Austria fulfils the protection standard for human trafficking victims under the ECHR.
