The disarray of the 2015 refugee crisis is still fresh in minds of many. The political and legal response was inadequate and chaotic. This kick-started an academic discussion about the role played by / ought to have been played by EU institutions in mitigating the crisis. In this article I discuss the role played by the CJEU in this setting. I argue that the CJEU rightly restricted itself to interpreting the law rather than aiming to address the broken asylum law system.
